The point is that as long as you have content on a site that YOU put there, you are still bound to their T&C, which is *you can't sue us*, CG could in fact take it to arbritation for damages, etc.
Notice I didn't mention durgan at all.
From a copyright perspective, If you said that one comic is ripping off another comic, and I've never read either, how am I supposed to tell who is ripping off who? Using rules that I use at work, the plaintiff HAS TO BE the content owner or someone in legal representative of the content owner. A third party not in legal representative, is considered an anonymous report, and I can't take it down because how do we know Mookie didn't give permission for Durgan? How do I even know Mookie isn't ripping of Durgan? See that's the problem. Everyone reading the thread is fully aware of what is going on, but the original content (Mookie) is not asking for it to come down.
Durgan may be fully aware what he's doing or not, but it's his responsiblity, not CG's to make sure that his content is legal.
So to summarize:
a) If Mookie wants Durgan to come down, he has to ask for it
b) Mookie can not threaten legal action since he still hosts content on CG/KS
c) If Durgan continues to do what he does without a complaint direct from Mookie, then that's between him and Mookie.
This is the same reasoning for sprite comics and fan comics. I don't know if someone is stealing anything, which is why 99.9% of comics are simply auto-approved.
CG is -NOT- youtube or myspace, it's not under as much scrutiny from the media, so this is just a one-sided complaint. It's no different than someone making an anonymous complaint that they don't like something so they want it gone.

I did send Mookie an e-mail, which... broadly covered the subject. I think I just demanded he link to me on his main page or something. I could have been drunk, possibly? I don't remember.
I sent him another one recently but that just said "PAAAARP". Again, not sure why.
So, since he's never responded to me or tried to discuss my beautiful retelling, I'm assuming he's perfectly fine with it. He knows my e-mail address, I know his, so if he wants to talk he can talk. But apparently he's more concerned with writing the most dastardly villain ever to take form in fiction of any kind - SOME GUY WHO WANTS TO STEAL DOMINIC'S GIRLFRIEND.
I mean seriously if I was working at a magic university where all the chicks apparently put out like crazy, I wouldn't go for the one ugly one of the bunch.

Maybe Neileen is trying to sink a wedge into the relationship because it's something fun to do, and he's planning on 'dumping' Luna afterwards, and not because he actually wants her. So, Luna's content to wallow in her own freakish misery and refuse to do any of the perfectly reasonable things she could do to solve her problem, when along comes the sugoi Deegan-sama~~~ who teaches her the true meaning of Christmas. Smiles and joy all round, because suddenly nobody finds her as hideous as they apparently once did.
You can look past all the various plot holes - Luna's teeth, incoherent magic, every other moment of "drama" - and just look at it this way: Dominic Deegan has fought witches, monsters, cultists, demons, extraplanar horrors, but now... now... he must fight his greatest battle of all.
He must stop some guy from makin' time with his girl.
Forgive me for not biting my nails here, but like all Deegan plotlines this is going to end with Dominic pulling some unforseen deus ex machina out of his backside in order to 1-up the bitch like he's Super friggin' Mario. Then the Goddamn cat will make a pun or some horrible alliteration and that'll be the "punchline" and everyone will laugh and go "Oh, Spark, you card!"
There's telegraphing the plot, and then there's Deegan, who does it so badly you'd think you actually had precognition (ironically enough). Scooby-Doo isn't as predictable, for crying out loud.

There's a very simple resolution to any plagurism...
If you stated your artwork is not to be reproduced elsewhere, and the art is then used elsewhere, then clearly it's in violation.
I found when that has happened to me that threats of a copyright suit don't quite have the same effect as sending the party a bill for using your art (including time, materials, etc) stating they could keep it up, as long as they pay that bill for services rendered.
That usually gets a quick response.
