Mindmistress' Big, Ugly SIster...

Post by Alschroeder »

I did a Google image search under Mindmistress, and saw this at http://ceejayink.fcpages.com/illustrations.htm (you might have to scroll down)---with no less than a copyright on the name, as of this year. Since I've been doing this for almost three years, you think I should drop them a line and advise them they might want to change the name?
Y'Think?
Or should I just let it pass like this site almost inevitably will do?
And why is she built like the Incredible Hulk in drag?

*Shudder*

She was ooglie. I'd say don't worry about it unless this person decides to do anything with the "character". Keep one eye creepily strained on the site for the rest of it's life. Best answer ever.

I think part of having copyright is knowing when to enforce it. if the person loooks like they definitely intend to do something with it, especially something where they plan to make money, then you might want to drop a friendly email just to make sure there isn't bad blood in the future. I know I might be a little upset if I was selling my stuff then suddenly had to go back and change the character's name and possibly retract stuff already started, even if the owner was in the right.
But if this is just a hobby thing like a webcomic or an art gallery then I say let them have it. Or send them an emailing informing them of your previous ownership but give them limited permission to use if for non profit work, etc.

....and boy does she have a case of camel toe.

A few months ago I found I too have the same name as a webcomic. fortunately I got it first.

Dang, I broke it. Maybe that's your solution: have a few dozen people click to it each day until she has to fork over a bunch of cash to up her bandwidth allowance? (only 40Mb a day? Sheesh!)

Just let it pass.

Strangely Velvet Acid Christ has a song called Decypher.. to bad it predates my comic by about three years and has nothing to do with coffee.

the ironic part is that I have owned that album (the first and the last VAC album I ever owned.. not really a fan) and didn't even realize there was a song called decypher until someone pointed it out.

It sure is, and I'm a little disappointed - after this buildup, I want to see this beast.

I was just Googling my name, too, and I was kinda taken aback by all of the pictures of dressed up dogs I'd found. I also found THIS PAGE a bit disturbing. Seems I'm a marked man. :o

Anyways, joke aside, names and titles CAN'T be copyrighted. They can be trademarked, but that's a different process in which different protections are extended to different things for different purposes.

I'd recommend everybody in the U.S. bookmark these two links in the very least:

http://www.copyright.gov
http://www.uspto.gov/

For all of the Canadians infesting the forums...

http://cipo.gc.ca/

And for everybody else, pick a country here...

http://www.wipo.int/news/en/links/addre ... /index.htm

I've been studying intellectual property law for nearly a decade now, copyright law specifically. I'm no lawyer, but I'm pretty confident in my knowledge and resources. I also like to take every single opportunity imaginable to expound on the subject. So, if anybody has any questions, do feel free to ask. I'll do my level best to get some sort of info toward your direction.

It just goes to show that you don't know geek until you've met a LAW geek. Be afraid.

Good to know. I'll do a comic called "Spider-Man"...or maybe "Batman"....
JUST KIDDING!!!!
Sorry. I know there's a difference between copyright and trademark. It's still disconcerting, though.
As you all were. Sorry about that.---Al

I don't know. If that ever happens to me, I'll ask forum what they think.
