Actually it can be marquise or marquee for the theater sign, marquis or marquess for the nobleman.

And just to muddy the water some more - a marquise can be a female marquis! :D

That's why there is a set of laws agreed upon by the community. You commit a crime once you go against those laws and, therefore, against the agreed upon morality of the community.
